C.R. Bard Vaginal Mesh Lawsuit News: Federal Litigation Issues New Pretrial Order Following Submission of Amended Responses to Master Complaint

Bard, Inc. continues to move forward in the U.S. District Court, Southern District of West Virginia. According to a Pretrial Order dated April 9th, a Scheduling Conference was convened that day, after certain defendants submitted amended responses to the Plaintiffs’ Master Long Form Complaint. The Order directed that any Preliminary Motions referenced during the Conference, as well as supporting memoranda, were to be submitted to the Court by April 23, 2015. Court documents indicate that more than 10,800 transvaginal mesh lawsuits are pending against C.R. Bard in the Southern District of West Virginia, all of which were filed on behalf of women who allegedly experienced severe and life-changing complications following implantation of surgical mesh devices to treat pelvic organ prolapse and stress urinary incontinence. Among other things, plaintiffs accuse C.R. Bard of failing to warn patients and the medical community about the risks allegedly associated with their transvaginal mesh products, and of failing to adequately test the devices to ensure their safety and effectiveness.
According to court records, the federal C.R. Bard litigation is just one of seven vaginal mesh proceedings currently underway in the Southern District of West Virginia, where more than 75,000 complaints have been filed.
