Cantor & Burger, LLC Featured in Missouri Lawyer's Weekly for Personal Injury Settlement
St. Louis, MO (PRWEB) December 30, 2014 -- A personal injury case settled out of court by Cantor and Burger, LLC partner and attorney Gary Burger was featured in an article in the Dec. 1 issue of Missouri Lawyer's Weekly.
Client Patricia Stevens from Springfield, Illinois, was driving through Southeast Missouri when a Missouri Department of Transportation garbage truck allegedly backed up and caused Stevens to be involved in a collision. Whiplash from the accident gave Stevens a severe neck injury that eventually required extensive neck fusion surgery to resolve.
The injury occurred in Aug. 2009, and a trial was set for July 2010 when the MoDOT refused to compensate Stevens' injuries in full (Case: 12PE-CC00401).
"The case was set for trial because we did not agree with the MoDOT on what the appropriate settlement amount for Stevens' injuries should be," said Burger. "Consequently, we chose to file a lawsuit."
In spite of the challenges, Burger managed to settle the case two weeks before the case went to trial. The defense even raised its settlement compensation significantly to meet the firm's demand of $305,000, despite its initial resistance.
"My videotaped deposition of Patricia's back surgeon caused the defendant to fully compensate Patricia," said Burger. "It can sometimes be challenging to get a state government to adequately settle an injury case -- but we did here."
Earlier this month, Stevens was awarded her settlement money, which paid for her medical bills and compensated her for pain and suffering.
The unique nature of the case got the attention of Missouri Lawyer's Weekly, a legal trade newspaper that reports on significant trends, verdicts and settlements in the Missouri area.
"This lawsuit was particularly unique in that we were up against an agency of the state of Missouri, and they typically have sovereign immunity protections," Burger said.
The article was featured in the Verdicts and Settlements Section of vol. 28, no. 47 of Missouri Lawyer's Weekly.
