Cantor & Burger, LLC Wins Dog Bite Lawsuit for Client
St. Louis, MO (PRWEB) February 19, 2015 -- According to court documents on Feb. 4, Cantor & Burger, LLC partner and attorney Gary Burger won a favorable verdict at trial for a dog bite case that began eight years ago.
According to court documents Case number 111-CV07377-01, William Andler vs. Mark Fellows, Sr., Rose Fellows, Danny Fellows began when William Andler was bitten near the mouth by a neighborhood dog. Because the bite didn't leave that much of a visible scar and the dog didn't have a history of biting, the law firm that eventually passed the case to Cantor & Burger, LLC was having a difficult time getting the owners of the dog to settle. No money was ever offered to settle the case.
Burger took the case to trial in St. Charles County, Missouri beginning on February 3, 2015, seeking $3,500 in medical bills and additional damages for pain and suffering.
"My client is a great kid with a great family," Burger said. "I told the jury that I couldn't be more proud to represent them. I was able to show that the defendants were fabricating stories on the witness stand and that was clear to everyone in the courtroom."
According to court documents Burger conducted a lengthy voire dire to inquire of juror's beliefs. The court struck 28 out of the 50 jurors for cause because they expressed opinions that they weren't willing to award pain and suffering or that they would require too much proof to provide pain and suffering damages.
According to court documents under Missouri law, individuals can't serve as jurors on cases where they've clearly formed or expressed opinions that could affect their judgment of the case. Because the jurors had expressed personal or political opposition to providing pain and suffering damages in the case, and because the law requires jurors to not have already formed or expressed an opinion, they could not serve on this jury.
The dog involved also posed a challenge, but not one that Burger couldn't overcome in the courtroom. "Dog bite cases are tough because some laws indicate that the dog has to have a previous history of biting people," Burger explained. "In this case, there was no evidence of previous biting behavior, but we were able to prove the owner was negligent and that they had a dangerous dog on the premises."
As a result, Burger's client was awarded $20,000 by the jury, which was considered a good and fair verdict based on the damages sustained.
