Cantor & Burger, LLC Wins Favorable Settlement for Truck Accident Victims
St. Louis, MO (PRWEB) February 10, 2015 -- Cantor & Burger, LLC truck accident attorney and partner Gary Burger settled a collision case on Jan. 9 that involved a commercial truck colliding with a family vehicle.
According to court documents, Case #12-L-22 of the Circuit Court of Monroe County, Twentieth Judicial Circuit, State of Illinois, was filed after the car carrying plaintiffs Lennis Cossey, Sharon Cossey and Alline Greer was hit by tractor trailer truck driver James Barksdale of Hogan Transports, Inc. on Route 3 in Waterloo, IL.
Husband and wife Lennis and Sharon Cossey and grandmother Alline Greer were traveling home from a family dinner when the collision occurred. According to court documents, they were approaching an intersection when the truck, which was making a local delivery at night, made a left hand turn in front of them. Lennis Cossey didn't have time to stop and skidded into the front of the tractor trailer.
"The truck driver allegedly did not get out of his vehicle, apologize, or even speak to my clients," said Burger. "Instead, he allegedly called his headquarters and within a half hour, had a lawyer and a claim agent at the scene taking statements and pictures. So, when we say that trucking companies, insurance companies, or big corporations are working immediately against you on these cases, we are not exaggerating."
The lawyers from the truck company allegedly arrived on the scene so quickly that they were able to snap pictures of Burger's clients as they were being taken away in the ambulance.
According to court documents, all three clients were transported to St. Anthony's Hospital, where Alline Greer and Lennis Cossey were treated for soft tissue injuries. Sharon Cossey, however, required treatment for a broken bone in her hand and continues to experience reflex sympathetic dystrophy and other ongoing problems.
After extensive litigation (and mediation in Sharon Cossey's case), Cantor & Burger, LLC was able to get a total of $305,000 for their clients from the defendants as well as $10,000 from each client's own insurance companies to cover medical payments.
Lennis Cossey was notified of his settlement on Sept. 23, Greer was notified on Oct. 2 and Sharon Cossey was notified on Dec. 26, 2014. Everything was finalized in court on Jan. 9, 2015.
"It was a long battle to get all injured parties fair compensation here," said Burger. "The defendant fought us all the way, but my clients and I persevered."
