Civil Rights Violation Lawyer David Perecman Cautions Retailers to Avoid Racial Profiling and Discrimination

Two African-American shoppers at Barneys New York claimed that the store racially profiled them. Trayon Christian, 19, was stopped by undercover New York City police officers after purchasing a $350 Ferragamo belt at Barneys. He was arrested and detained despite showing officers the receipt, the debit card he used and identification, said ABC News (10.29.13). Another black Barneys shopper said she was accused of fraud after purchasing a $2,500 handbag.
In another incident reported by ABC News, black actor Robert Brown said that he was handcuffed at Macy's and detained after being falsely accused of credit card fraud.
“Many people don't recognize how prevalent retail discrimination is,” said ABC News and Perecman agreed. Consumer racial profiling can range from subtle differences in treatment, such as getting ignored by a salesperson, to being followed and accused of shoplifting.
“Retailers must not engage in racial profiling,” said Perecman, a civil rights violation lawyer in New York for over 30 years. “New York has zero tolerance for discrimination. Stores or companies that discriminate may find themselves slapped with a lawsuit.”
