Basichis advises that often when conducting employment screening for upper level executives or those in the financial industries, the Federal Civil Records search is often overlooked. Basichis pointed out it is critical to search Federal Civil Records as well as Federal Criminal Records.
“Most clients are aware of conducting background checks for Federal Criminal Records,” said Basichis. “But this is a volatile global economy. We tell our clients Federal Criminal Records are only half the equation. We encourage them to add Federal Civil Records. Why? Often cases involving financial malfeasance are very complex and there is some concern with the prosecution whether the jurors would understand the full ramifications of the crimes committed. Add to that it takes twelve jurors to convict in Federal Criminal Court. So often the U.S. Attorney will move the case to Federal Civil Court where the threshold to convict is significantly less. Such a maneuver may also cause the defendant to settle on a civil case, where it may be more difficult in criminal cases where he would potentially be spending time in jail.
