Court Upholds $2 Million Vaginal Mesh Lawsuit Verdict Levied Against C.R. Bard in First Federal Bellwether Trial, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 22, 2015 -- The federal court overseeing thousands of vaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) in the U.S. District Court, Southern District of West Virginia has upheld a $2 million verdict levied against C.R. Bard, Inc. in that proceeding’s first bellwether trial. In an Order dated January 21st, the Court denied a defense request for a new trial after finding that C.R. Bard had not proven a miscarriage of justice. (Cisson v. C.R. Bard Inc., 11-cv-00195)
According to court documents, the trial had concluded in August 2013, with a jury finding that C.R. Bard was liable for the transvaginal mesh complications experienced by a woman who received the company’s Avaulta Plus mesh device to treat pelvic organ prolapse. After just 12 hours of deliberations, the panel awarded the plaintiff $250,000 in compensatory damages, along with $1.75 million in punitive damages.
“Our Firm is representing hundreds of women who have filed vaginal mesh lawsuits in the federal litigations involving C.R. Bard and other pelvic mesh manufacturers. We are pleased that the Court saw fit to uphold the jury’s decision in this bellwether case, which may ultimately provide valuable insight into how other juries will rule in similar claims,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free vaginal mesh lawsuit evaluations to women who allegedly suffered serious injuries following surgery to correct pelvic organ prolapse and stress urinary incontinence.
Vaginal Mesh Litigations
According to court documents, more than 10,000 transvaginal mesh lawsuits are currently pending against C.R. Bard in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. All of these cases were filed on behalf of women who allegedly suffered mesh erosion and other serious complications following implantation of the company’s pelvic mesh products. Among other things, plaintiffs claim that C.R. Bard did not adequately test its transvaginal mesh devices to ensure their safety and effectiveness, and failed to provide doctors and patients with sufficient warnings about their risks. Mr. Grand is also serving on the Plaintiffs’ Steering Committees in the remaining vaginal mesh litigations underway in West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: Coloplast Corp. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.
In addition to his work on the federal mesh litigations, Mr. Grand was also appointed Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March 2013 with an $11 million verdict for the Plaintiff.
