Litigation against DuPont began in 2001 when a class-action lawsuit was filed on behalf of nearly 70,000 Ohio and West Virginia residents who live near DuPont's Washington Works Plant in Wood County, West Virginia, where the C8 chemical had been released since the 1950s. C8 is another term for perfluorooctanoic acid, a man-made chemical used in producing such products as non-stick cookware, and protective finishes on carpets and water-resistant clothing. The class-action lawsuit accused DuPont of emitting C8 into public and private drinking water supplies and causing injuries and death to those who consumed the contaminated water. A settlement was reached between DuPont and the plaintiffs in 2005. (Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.))
As part of the class-action settlement, the C8 Science Panel was created as well as a C8 medical monitoring program for the thousands of Mid-Ohio Valley residents who were exposed to the C8 toxic chemical. In September 2014, a medical monitoring program began that provides free medical screening and a blood test for residents to determine whether they have illnesses that the science panel linked to C8 exposure. Under the class-action settlement, DuPont agreed to pay $235 million for the medical monitoring program. A website has been set up at c-8medicalmonitoringprogram.com for class-action members who want to participate in the medical monitoring program.

After the class-action lawsuit was settled, the U.S Judicial Panel on Multidistrict Litigation (JPML) consolidated all federally filed C8 lawsuits in the U.S. District Court, Southern District of Ohio. The C8 complaints were filed on behalf of class-action members who allege that they developed at least one of the six medical conditions identified by the C8 Science Panel. The JPML’s multidistrict litigation list shows 1,639 C8 lawsuits are pending in the Southern Ohio federal court as of January 15. According to an order issued in December by U.S. District Judge Edmund A. Sargus Jr., the parties involved in the litigation expect that there will likely be around 2,500 C8 lawsuits filed by the end of January. (In Re: E.I.
