DePuy ASR Lawsuit News: California DePuy ASR Recall Case Settled Ahead of Trial, Bernstein Liebhard LLP Reports

According to court documents filed in California’s San Francisco Superior Court, the settlement resolves claims in the DePuy ASR lawsuit that had been selected for the state litigation’s first bellwether trial. DePuy ASR Recall Litigations
According to court documents, the newly settled California lawsuit was one of about 2,000 DePuy ASR recall claims pending in a coordinated litigation underway in California Superior Court. Court filings indicate that Johnson & Johnson and its DePuy Orthopaedics unit are named in more than 11,500 DePuy ASR lawsuits, all of which were filed in the aftermath of the August 2010 DePuy ASR hip replacement recall. Most of those cases are pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where Bernstein Liebhard LLP is actively filing claims. The first bellwether trial in that litigation was also scheduled to begin this month, but has been postponed for up to 90 days. (In re: DePuy Orthopaedics, Inc. According to a recent report from Bloomberg.com, at least five other DePuy ASR lawsuits will head to trial over the next several months in litigations underway in New Jersey, Illinois, Florida and California.*
Two trials involving DePuy ASR lawsuits have already concluded at the state court level. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. According the U.S. Food & Drug Administration, the DePuy ASR recall was announced after data from a United Kingdom hip registry indicated that 12-to-13% of would experience premature failure of the device.
