DePuy Hip Replacement Lawsuit News: California Judge Allows DePuy ASR Lawsuit Plaintiffs to Add Pinnacle Hip Claims

According to court documents, California Superior Court Judge Richard Kramer has ruled that seven plaintiffs in DePuy ASR lawsuits now pending in the state’s consolidated proceeding will be allowed to add claims relating to the metal-on-metal version of the DePuy Pinnacle acetabular cup to their lawsuits. DePuy Hip Replacement Lawsuits
According to court documents, Johnson & Johnson’s DePuy Orthopaedics unit is facing thousands of claims involving its metal-on-metal ASR and Pinnacle hip replacements. The majority of DePuy ASR lawsuits have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197) While the first trial in the federal litigation is not scheduled to begin until September, a DePuy ASR lawsuit trial has already concluded in California Superior Court, with the Plaintiff awarded more than $8 million in damages. A second multidistrict litigation for all federally-filed claims involving the all-metal Pinnacle hip has been established in U.S. District Court, Northern District of Texas. Jeffrey S. According to court documents, plaintiffs with claims pending in both litigations allege the metal-on-metal hips have a propensity to shed dangerous amounts of metal debris, leading to adverse local tissue reactions and premature device failure. Plaintiffs in DePuy Pinnacle hip replacement lawsuits further allege the all-metal version of the device shares many of the same design defects that led to the recall of the ASR in August 2010.
The U.S. Food & Drug Administration (FDA) has been investigating metal-on-metal hip replacements since February 2011. In January 2013, the FDA advised all patients fitted with metal-on-metal hips to undergo metal ion testing if they were experiencing signs or symptoms of device failure. The agency has also proposed new rules that would subject all-metal hips to greater regulatory scrutiny.* On May 17th the New York Times reported that DePuy Orthopaedics had decided to phase out sales of metal-on-metal hip implants, including the all-metal Pinnacle, in part due to recent FDA actions.*
