DePuy Hip Settlement News: Rottenstein Law Group LLP Comments on DePuy Pinnacle Lawsuit Remand Hearing Delay
(PRWEB) December 13, 2013 -- A federal court has postponed remand hearings for more than 200 DePuy Pinnacle lawsuits pending the conclusion of bellwether trials that do not begin until September 2014, according to court documents. Special Master James M. Stanton issued the notice on Dec. 4, a move supported by plaintiffs and defendants in the DePuy Pinnacle lawsuits, according to court documents (In re: DePuy Orthopaedics, Inc., Pinnacle Hip Implant Products Liability Litigation; MDL-2244, U.S. District Court for the Northern District of Texas). There are currently more than 5,000 Pinnacle lawsuits pending in Texas in a consolidation of federal court cases for pretrial efficiency, according to court documents.
“The court is aware that not all of the consolidated cases belong in federal court, and those that belong in state court will have to be remanded,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “But the court also recognizes the utility of postponing consideration of which cases belong where for a little bit longer, because the outcomes of the bellwether cases might result in settlements, which would make remand motions moot.”
Pinnacle lawsuits are not included in the recently announced multibillion dollar DePuy settlement, according a Nov. 27 Bloomberg report.* However, like the ASR hip implant that is included in the settlement, the Pinnacle could cause serious alleged side effects such as device failure and metal poisoning, according to court documents. Unlike the ASR, which was recalled in 2010, the Pinnacle hip implant is still on the market.
