DePuy Hip Settlement News: Rottenstein Law Group LLP Comments on UK Metal-on-Metal Hip Implant Ban
(PRWEB) October 31, 2013 -- As ASR lawsuits mount and talks abound about a possible DePuy hip settlement in the United States, the United Kingdom’s National Health Service announced on Oct. 25 that it was banning metal-on-metal hip implants from its hospitals. The Rottenstein Law Group LLP, a metal-on-metal hip law firm, notes that this is a stronger action than that carried out by the U.S. Food and Drug Administration.
NHS ordered the ban because of high failure rates in 17,000 patients, according to an Oct. 25 article in The Telegraph.* Surgeons had become concerned that the joints were failing years earlier than advertised.
In the United States, the FDA did issue safety alerts** related to alleged ASR side effects, such as metal poisoning and device failure, but there have not been any bans of the kind here.
“The UK government owns and operates most aspects of that country’s medical system, so a wholesale ban such as this is easier for it to initiate,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “In the United States, the FDA can ban products but it does not own the medical facilities. In the case of hip implants, at least three medical device manufacturers have voluntarily recalled their metal-on-metal hip implant products, including Johnson & Johnson subsidiary DePuy, which recalled its ASR implant in 2010.”
DePuy is reportedly considering settling the more than 11,000 ASR lawsuits in the United States soon, according to an Aug. 21 Bloomberg report.*** The article indicated that a settlement offer could occur early next year or sooner, pending the outcomes of a handful of bellwether trials in federal court, some of which have already been settled (In re: DePuy Orthopaedics Inc., ASR Hip Implant Products Liability Litigation; MDL-2197, U.S District Court for the Northern District of Ohio).
