DePuy Pinnacle Hip Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Scheduling of Next Conference in Federal Pinnacle Hip Litigation

DePuy Pinnacle Lawsuits

According to court documents, over 5,400 claims are pending in the federal proceeding, all of which allege the metal-on-metal version of the Pinnacle hip that utilizes the Ultamet liner can shed dangerous amounts of metal debris into recipients’ tissue and blood stream. According to plaintiffs, this may result in metallosis and other serious complications that often necessitate replacement of the hip implant. The lawsuits further allege that the design of the all-metal Pinnacle shares some of the same flaws that caused DePuy Orthopaedics to recall ASR hip systems in 2010, and question whether the metal-on-metal Pinnacle should have been recalled as well.
In January 2013, the U.S. Food & Drug Administration (FDA) issued a public health alert, after determining that metal-on-metal hips were more likely to fail prematurely compared to those made from other materials. Among other things, the agency recommended that recipients of these devices undergo metal ion blood testing if they experience pain, swelling, audible noises from the hip, or any other sign that could indicate their hip replacement is failing. The FDA also disclosed that it was considering new regulations for metal-on-metal hips that would subject the implants to greater regulatory scrutiny.
In May 2013, Bloomberg.com reported that DePuy Orthopaedics had decided to phase out sales of metal-on-metal hip implants, including the all-metal Pinnacle, in part due to recent FDA actions.*
