According to an Order issued on November 15, 2013, the Court has scheduled hearings for December 5th and 6th, at which time the proceeding’s Special Master will consider Motions for Remand filed in 270 Pinnacle hip lawsuits. The Order directs that the hearing session scheduled for December 5th will involve cases in which the plaintiffs reside in California, while the hearing to be conducted on December 6th will take up motions filed in claims from other states, including New Jersey and Maryland. DePuy Pinnacle Lawsuits
Court documents indicate that more than 5,200 DePuy Pinnacle lawsuits involving a metal-on-metal version of the hip implant that utilizes the Ultamet liner are currently pending in the litigation underway in the Northern District of Texas. All of the lawsuits involve similar allegations regarding the Pinnacle hip’s propensity to shed dangerous amounts of metal debris into the tissue surrounding the device, as well as the blood stream. Plaintiffs further allege that the accumulation of this metal debris can result in any number of painful and debilitating complications, including metallosis, pseudotumor formation and premature failure of the device. The lawsuits also claim that the all-metal Pinnacle shares certain design flaws with DePuy ASR hips, another line of metal-on-metal implants marketed by DePuy Orthopaedics that was recalled in 2010. The claims question whether the Pinnacle hip should have been recalled as well.
In the wake of concerns that metal-on-metal hips were failing at a higher rate than those made from other materials, the U.S. Food & Drug Administration (FDA) launched a review of such devices. In January 2013, the FDA advised that patient fitted with an all-metal hip should undergo metal ion testing if they were experiencing signs or symptoms of device failure, such as pain and swelling around the joint, mobility issues, or popping, squeaking or clicking sounds coming from the hip. The agency has also proposed new rules that would subject all-metal hips to greater regulatory scrutiny, including a regulation that would require the manufacturers of metal-on-metal hips currently on the market to conduct safety studies of their products if they plan to continue selling them.
In May 2013, Bloomberg.com reported that DePuy Orthopaedics had decided to phase out sales of metal-on-metal hip implants, including the all-metal Pinnacle, in part due to recent FDA actions.*
