DePuy Settlement Update: Nov. 19 Conference Could Involve ASR Hip Settlement Talks, Rottenstein Law Group LLP Reports
(PRWEB) November 18, 2013 -- A federal court judge handling DePuy ASR hip lawsuits ordered on Friday an open court conference for Nov. 19. The Rottenstein Law Group LLP, which operates the DePuy settlements informational website http://www.depuysettlements.com, notes that the meeting’s rather last-minute scheduling could be related to settlement talks.
The 4:30 p.m. open court conference was scheduled just days after widespread media reports, such as a Nov. 13 New York Times article, of a $4 billion settlement Johnson & Johnson and subsidiary DePuy Orthopaedics will reportedly pay to resolve as many as 8,000 state and federal ASR metal-on-metal hip lawsuits, according to court documents (In re: DePuy Orthopaedics Inc., ASR Hip Implant Products Liability Litigation; MDL-2197, U.S District Court for the Northern District of Ohio).
“Status conferences in federal case consolidations are often scheduled months in advance and are typically routine, set up as an opportunity for all parties to discuss matters pertaining to pretrial proceedings,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “The circumstances of the scheduling of this meeting could indicate that the parties will be discussing the proposed settlements of all pending cases.”
Each claimant whose lawsuit is part of the DePuy settlements would receive about $350,000 on average, according to the Times, which also said that although there are more than 12,000 lawsuits filed to date, the settlement would involve only those people who had undergone revision surgery to replace defective ASR implants.
In 2010 Johnson & Johnson recalled 93,000 hip implants, including 37,000 in the U.S., after more than 12 percent failed within five years, according to the Times.
