Omaha, NE (PRWEB) November 20, 2013 -- On October 18, a New Mexico jury awarded Horne Stewart LLC $3.57 million after finding that Bernalillo County and the City of Albuquerque willfully breached its 1997 land contract (Case # D-202-CV-2005-05603, New Mexico 2nd Judicial District Court).
David Domina together with Felicia C. Weingartner represented Horne Stewart, a family-owned business, in this condemnation action turned breach of contract case. The verdict put an end to a 2005 lawsuit between Horne Stewart and the City of Albuquerque, Bernalillo County, New Mexico and the University of New Mexico.
Domina and Weingartner claimed that both the City of Albuquerque and Bernalillo County breached the contract it had entered into with their client by refusing to build the road as agreed. The way the City and County built the road dissected Horne Stewart’s 540-acre parcel affected their ability to develop adjacent land.
Evidence presented before Judicial Officer, Clay Campbell, effectively showed that the City and County favored another development, a development backed by the former Albuquerque Mayor as well as New Mexico’s previous Governor. This New Mexico jury voted unanimously in favor of Domina and Weingartner’s client.
