Driver Who Plowed Through Three Homes
Houston, Texas (PRWEB) July 30, 2013 -- Residents of a Cook Road townhouse bolted awake Friday night when an SUV came barreling through the front wall of their home. The SUV plowed through three townhouses before coming to a stop, and the driver was later arrested on suspicion of driving while intoxicated – but DUI lawyer Dane Johnson says that charge raises questions.
The driver apparently missed a turn while heading north, crashing into the houses. A family of four was sleeping in the first house hit, and the third home had a female occupant. No one was hurt according to KHOU (7.19.13).
Police say the driver fled on foot but was later arrested in his apartment.
“Obviously, someone could have been killed and the driver has to face the consequences,” said Johnson, a founding partner of the Johnson, Johnson & Baer criminal defense law firm. “The charge of drunk driving raises questions however, because there is no mention of a breath test – which almost certainly would have been conducted.”
Johnson says that a sober driver could miss a turn in a moment of distraction.
“The message we get over and over is that drunk drivers cause accidents, so when an accident happens people assume someone was drunk,” Johnson said. “The reality is we don't know the details of this case.”
Even if acquitted of driving while intoxicated Johnson says the driver will be liable for damages to the homes.
