The lawsuit claims that the Plaintiff, who worked as an Environmental Services Manager, spent most of his workday engaged in manual labor. According to the Complaint, Plaintiff and other Environmental Services Managers engaged in the manual tasks of collecting trash and cardboard boxes from various locations in hospitals, removing dirty linens, scrubbing and waxing floors, and conducting inventory of used towels and mops at the end of the workday, among other tasks. The lawsuit also claims that the Plaintiff did not manage other employees and was therefore a "manager" in name only because he did not have managerial duties and should therefore have been paid overtime wages and provided with meal and rest periods in accordance with California law.
