Ethicon Transvaginal Mesh Lawsuit Heads to Trial in California Superior Court, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 28, 2015 -- Transvaginal mesh lawsuits (http://www.filevaginalmeshlawsuit.com/) filed against Johnson & Johnson’s Ethicon, Inc. unit continue to move forward in state and federal courts around the country, Bernstein Liebhard LLP reports. According to court documents, a trial involving Ethicon’s TVT-Abbrevo pelvic mesh sling opened on January 26th in the Superior Court of California, Kern County. The Plaintiff in the case, a woman who received the TVT-Abbrevo sling in 2011 to treat stress urinary incontinence, claims that the device has caused her continuing pain and urinary problems, even after she underwent surgery to remove the mesh. During Monday’s Opening Statements, her attorney told the assembled jury that the Plaintiff would present evidence showing that the “product was not reliably tested before it was sold and, in fact, her doctor wasn’t told the full truth about the dangers of the product.” (Perry v. Ethicon Inc., et al., S-1500-CV-279123)
“Our Firm is representing hundreds of women in state and federal courts who are alleged to have experienced similar vaginal mesh complications due to products manufactured by Ethicon and other companies. We are closely monitoring mesh trials around the country, as their outcomes may provide insight into how other juries will rule in similar claims,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to investigate legal claims on behalf of women who suffered serious vaginal mesh complications, allegedly due to products marketed by Ethicon and other manufacturers.
Transvaginal Mesh Litigation
According to court documents, more than 20,000 claims have been filed in U.S. courts on behalf of women who were allegedly harmed by Ethicon’s transvaginal mesh products used to treat pelvic organ prolapse and stress urinary incontinence. The majority of these lawsuits are pending in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, where Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)
In September 2014, the jury hearing arguments in the federal litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the Ethicon TVT-O Mesh sling. (Huskey v. Ethicon, Inc. et al, Case No. No. 2:2012cv05201) The proceeding’s third bellwether trial is expected to begin in March.
In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10)
Court records indicate that more than 67,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia. Mr. Grand is also a member of the Plaintiff’s Steering Committees for the remaining vaginal mesh litigations: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2187; Coloplast Corp. Pelvic Support Systems Products Liability Litigation - MDL No. 2387; In Re: Cook Medical, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2440; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.
Mr. Grand has also been appointed Co-Liaison Counsel in a second proceeding underway in New Jersey Superior Court for lawsuits filed against C.R. Bard. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Alleged victims of serious vaginal mesh complications may be entitled to compensation for their injury-related damages.
