Ethicon Vaginal Mesh Lawsuits Move Forward, As Federal Court Schedules Hearing on Plaintiffs’ Motion for Sanctions, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 22, 2014 -- The federal court overseeing thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against Ethicon, Inc. has scheduled a hearing to consider a Motion for Sanctions filed by plaintiffs with claims pending in the proceeding. According to an Order issued in the U.S. District Court, Southern District of West Virginia, on January 17, 2014, the hearing will commence on January 23rd at 1:30 p.m. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)
According to court documents, plaintiffs filed a motion on December 10, 2013, claiming that Ethicon lost or destroyed certain documents relevant to their transvaginal mesh lawsuits. The motion sought to bar the company from using certain defenses in bellwether trials that are scheduled to get underway in the federal multidistrict litigation later this year. Plaintiffs filed a supplemental motion on December 27th claiming that a number of additional documents had been lost or destroyed. In a response filed on January 10th, Ethicon admitted that some of its employees had made errors relating to document preservation protocols, but the company maintained that it has been diligent in responding to plaintiffs’ requests.

Transvaginal mesh Lawsuits
Court documents indicate that Ethicon, a unit of Johnson & Johnson, is named in more than 13,000 transvaginal mesh lawsuits that have been filed in the Southern District of West Virginia. All of the lawsuits claim that Gynecare pelvic mesh products were defectively designed and manufactured, and caused women to suffer mesh erosion, organ damage, chronic pain, and other serious transvaginal mesh complications. The first bellwether trial in the federal Ethicon litigation is scheduled to begin on February 10, 2014.
According to court records, Ethicon and Johnson & Johnson are also facing more than 4,600 similar transvaginal mesh lawsuits pending in a consolidated proceeding underway in New Jersey’s Atlantic County Superior Court, where the first trial ended in March with an award of $11 million to the Plaintiff.
