Federal Court Overseeing C.R. Bard Transvaginal Mesh Lawsuit Allows Failure to Warn, Punitive Damage Claims to Stand, Bernstein Liebhard LLP Reports

Bard, Inc. continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to Orders issued by the Court last week, a Plaintiff seeking compensation for vaginal mesh complications allegedly caused by the company’s Avaulta Plus Anterior Support System and the Avaulta Plus Posterior Support System will be able to pursue her failure to warn and punitive damage claims. In an Order dated February 5th, the Court rejected C.R. Bard’s Motion for Summary Judgment on the failure to warn claims after finding that the Plaintiff cited numerous instances where her surgeon said he would never have used the Avaulta device had he known of its risk. The following day, the Court issued another Order allowing the lawsuit’s punitive damage claims to move forward, disagreeing with C.R. Bard’s contention that its compliance with federal regulation in its handling of the Avaulta products precludes such claims. (Case No. No. 2:12-1378)
