Bard, Inc. has issued an Amended Docket Control Order pertaining to selection and discovery in 200 cases for upcoming bellwether trials, Bernstein Liebhard LLP reports. Firm partner, Jeffrey S. “The February 19th Order notes the confidential settlement reached in the C.R. Bard case that was scheduled to go to trial in the Southern District of West Virginia earlier this month. Transvaginal Mesh Litigation
Court documents indicate that more than 10,000 lawsuits have been filed in the Southern District of West Virginia on behalf of women who allegedly suffered serious vaginal mesh complications due to products marketed by C.R. Bard for the treatment of pelvic organ prolapse and stress urinary incontinence. Bernstein Liebhard LLP notes that three bellwether cases have already been resolved in the litigation, the first in 2013 with the jury ordering C.R. Bard to pay $2 million in compensatory and punitive damages to a woman injured by its Avaulta mesh device. (Case No. 11-cv-00195) A week later, an undisclosed settlement was reached in what would have been the proceeding’s second bellwether trial. (Case No. 11-cv-00012). Then just last week, a confidential settlement was reached in the third bellwether case, which was scheduled to go to trial on February 18th. (Case No. No. 2:12-1378)

Bard litigation and settlements were reached in two others, the Court’s February 19th Order indicates that this litigation is far from over, as many cases remain to be tried.
