Federal Lipitor Litigation Issues New Order Pertaining to Discovery in Bellwether Cases, Bernstein Liebhard LLP Comments
New York, NY (PRWEB) February 27, 2015 -- The federal court overseeing more than 1,800 Lipitor lawsuits (http://www.lipitorlawsuitcenter.com/) that allege use of the statin medication can increase a person’s risk for developing Type 2 diabetes has issued a new order pertaining to discovery in the cases selected for the proceeding’s first two bellwether trials, Bernstein Liebhard LLP comments. The Order, which was issued in the U.S. District Court, District of South Carolina, on February 25th, directs the parties to schedule certain witness depositions before May 15, 2015. Among other things, the Order also notes that collection of certain records pertaining to the bellwether plaintiffs will continue through September 21, 2015, or four weeks before trial, whichever is later. Lipitor Diabetes Litigation
Court documents indicate that all of the Lipitor lawsuits pending in the District of South Carolina similarly allege that the Pfizer, Inc. failed to warn patients that use of the cholesterol-lowering statin can cause Type 2 diabetes. In an Order dated January 30th, the Court designated four lawsuits as bellwether trial candidates, and indicated that the first trial would involve a case filed on behalf of a woman who alleges that she was in good health before she began taking Lipitor, and later developed diabetes due to its use. An Order issued on February 4th directed that the case would go to trial on October 19, 2014
According to court documents, the U.S. Food & Drug Administration (FDA) announced that the labels for Lipitor and other statins would be updated to include new information about their potential association with Type 2 diabetes. However, plaintiffs in Lipitor lawsuits claim that new information added to the drug’s label following the FDA’s announcement fails to adequately warn patients about the drug’s association with diabetes.
