Federal Litigation Presiding over Tylenol Lawsuits Looks Ahead to Status Conference in December, Bernstein Liebhard LLP Reports

According to a Scheduling Order issued earlier this year, a conference in the Tylenol proceeding will take place on December 16th at 10:00 a.m. Items likely to be discussed at the meeting include lawsuits that allege liver damage injuries caused by the pain reliever’s active ingredient, acetaminophen. Complications may have resulted in hospitalization, the need for a transplant or even death, plaintiffs allege. Court documents show 163 Tylenol liver damage lawsuits now pending in the Eastern District of Pennsylvania, after being filed by people who accuse Johnson & Johnson and McNeil Consumer Healthcare of failing to adequately warn consumers about the alleged risks of acetaminophen, even when medications are taken in accordance with label directions.
An investigation led by Consumer Reports recently lent evidence to the frequency of acetaminophen injuries, finding that 80,000 people are sent to the emergency room each year because of complications caused by the active Tylenol ingredient. Even if just for a few days, the probe also found that exceeding 4,000 milligram daily dosages of acetaminophen for just a few days can lead to liver damage and other complications. The daily limits recommended for many over-the-counter medications are often very close to that amount, however, Consumer Reports noted.*
In January, the U.S. Food and Drug Administration (FDA) finalized new guidance for acetaminophen amounts in prescription medications, which do not apply to over-the-counter Tylenol products. Caplets should each contain no more than 325 milligrams of acetaminophen, the regulations stated.
A Bloomberg.com report published in August 2013 reported that over-the-counter Extra Strength Tylenol pills contain 500 milligrams of the ingredient, significantly more than the FDA-recommended amount for prescription medications.**
