Fire Engine Crashes Into Dairy Queen, Injured Customer Files Lawsuit Against Siddons-Martin Emergency Group
(PRWEB) June 15, 2016 -- Dale Rose filed a lawsuit in the Collin County 401st District Court alleging the negligence of Siddons-Martin Emergency Group and their employee, Christopher Shawver (case no. 401-02143-2016).
Siddons-Martin Emergency Group is a Houston-based company that sells fire trucks and emergency vehicles and products to those in the industry. According to court documents, on January 20, 2016, Siddons-Martin Employee Christopher Shawver was driving a fire engine to return to the Greenville Fire Department following a repair. While in route to Greenville, Shawver allegedly lost control of the fire engine while driving on US-380 in Farmersville, Texas. According to the lawsuit, police say the vehicle crossed a grassy median, ran into a guard rail, crossed oncoming lanes, struck an exit sign, hit an embankment and went airborne before landing in the parking lot of Dairy Queen. The fire engine then crashed into the restaurant and two cars sitting in the drive-through lane according to the filing.
According to court documents, the first vehicle struck was spun around by the fire engine. The lawsuit goes on to claim that the driver was injured from the impact and due to bricks flying through the drivers-side window. On behalf of the driver of that vehicle, Personal Injury Attorney Dale Rose has filed a lawsuit pointing to negligence on both Siddons-Martin and their driver.
The filing claims that Shawver was allegedly driving at an excess rate of speed and he failed to apply his brakes in a timely manner. The lawsuit also alleges that the driver was under the influence of a foreign substance while operating his motor vehicle.
According to claims made in the suit, Mr. Shawver allegedly did not exercise the degree of care that a reasonable person would to avoid harm, resulting in his negligence, carelessness and recklessness. The lawsuit claims negligence on the part of Shawver’s employer, Siddons-Martin. The suit alleges Siddons-Martin had a duty to adequately train and supervise Christopher Shawver.
“The lawsuit alleges that the company is responsible for allowing an allegedly incompetent and reckless driver perform a task under their direction,” Attorney Dale Rose says. “The plaintiff is seeking significant damages in the case.”
Collin County Judge Mark Rusch has been assigned to preside over the civil case while authorities conduct a criminal investigation.
