Fleming | Nolen | Jez, L.L.P. Files Ariel Grace Lawsuit in North Carolina
(PRWEB) December 28, 2016 -- Earlier this month, the attorneys at Fleming | Nolen | Jez, L.L.P. filed a lawsuit against Bayer Corp., Bayer Healthcare LLC, Bayer Essure®, Inc., Bayer Healthcare Pharmaceuticals, Inc., and Christopher Ford Williams, a Bayer sales representative.
The lawsuit was brought forth on behalf of Kristiana Tweed Burrell, a mother from North Carolina who, according to the case, received the Essure® permanent birth control in December of 2013 at Mission Hospital. The Essure® device works as a permanent contraceptive as metal coils are placed in the woman’s fallopian tubes and scar tissue forms, preventing fertilization.
Despite the insertion of the Essure® birth control, the complaint claims that Mrs. Burrell’s follow-up exams showed that the device was not working properly and the procedure had failed. Mrs. Burrell used other birth control methods, but she became pregnant.
In June of 2015, she started to experience abdominal pain and vaginal bleeding. She then had rupturing of membranes and partial delivery of a breech baby while at her home. On June 8, 2015, she had a stillborn baby girl, Ariel Grace Burrell. The complaint claims that according to medical records, one of the obstetricians informed Mrs. Burrell that the cause of the abruption was likely the Essure® device.
According to the complaint filed with the court, the Essure® coils had extended past the fallopian tubes and into the uterine cavity, resulting in the sharp tips of the Essure® implants connecting with fetal membranes. This allegedly caused a premature rupture, leading to the stillbirth.
Rand Nolen, an attorney at Fleming | Nolen | Jez, L.L.P., released a statement, claiming “This tragic case is sadly one of thousands that have or will be filed for woman who allege that they have been harmed by the Essure® birth control medical device.”
The case is currently pending in the General Court of Justice Superior Court Division in Buncombe County, North Carolina.
