Florida 1st District Court of Appeals Agrees With Choice Plus, LLC In Recent Case Regarding Unclaimed Property Determination Deadlines

Choice Plus, LLC recently filed a legal action with the 1st District Court of Florida (Case No. 1D14-0124) for a ruling regarding the legal interpretation of a law that requires the Florida Department of Financial Services, Bureau of Unclaimed Property (“Department”) to make claim determinations within a specific length of time.
According to Mr. Hotz, unclaimed property claims were not being determined by the Department when required, leaving owners without their property longer than the legislature intended. The Department claimed that the law in question was suggestive and did not mandate the Department to abide by the specific deadlines.
Choice Plus, LLC presented their understanding of the law to the Florida 1st District Court. The court agreed with Choice Plus, LLC and stated that the law in question is, in fact, a mandatory requirement. The Department is not allowed to extend the timeframe set by the statute.
According to the court decision, “While the Department certainly has the discretion to deny a claim if warranted, the legislature has clearly provided timeframes under which the Department is to act.”
