Parker Waichman requested a transfer of the domain name, yourlawyerfl.com, from the other law firm, asserting Parker Waichman’s trademark rights in YourLawyer and YourLawyer.com.
The National Arbitration Forum arbitrated the Uniform Domain Name Dispute Resolution Policy (UDRP) action under which trademark-based domain name disputes are typically resolved by agreement, court action, or arbitration prior to a registrar canceling, suspending, or transferring a domain name.
Parker Waichman LLP’s allegations included that, yourlawyerfl.com is “confusingly similar to its trademarks,” YourLawyer and YourLawyer.com; the Respondent in this case does not have rights or legitimate interests in this domain name; and the Respondent registered and used the disputed domain name of yourlawyerfl.com in bad faith.
In this action, Parker Waichman LLP prevailed and the domain name—yourlawyerfl.com—was ordered transferred. The Panel was satisfied that Parker Waichman LLP established all three aspects under the Internet Corporation for Assigned Names and Numbers (ICANN) policy and concluded that relief is granted and ordered that the yourlawyerfl.com domain name be transferred to Parker Waichman LLP.
