According to a report from the Associated Press, the Fund will open to claims on August 1, 2014.
The GM Victims Compensation Fund was established to compensate the families of those killed, as well as individuals who were severely injured, in automobile crashes associated with a defective ignition switch that has resulted in the recall of millions of GM cars. According to the GM recall notice, the ignition switch in question can unexpectedly and suddenly move from the “On” or “Run” position to the “Off” or “Acc” position. When this occurs, the motor engine and certain electrical components, including the power assisted steering and anti-lock brakes are turned off, thereby endangering the vehicle occupants and compromising the safety airbag system.

• 2003-2007 Saturn Ion

According to an earlier report from Washington Post, at least 13 auto fatalities have been linked to the defective ignition switch. A congressional probe also determined that GM had made a modification to the ignition switch in 2006 that resolved the issue, but did not publicly disclose the problem or announce a recall at that time.

According to the Associated Press, those eligible to participate in the GM Victims Compensation Fund include drivers, passengers, pedestrians, and people in other cars involved in crashes with recalled GM vehicles who suffered physical injuries or relatives of people killed in crashes. Claimants must show that the crashes were caused by faulty GM ignition switches. Those who settle their claims through the Fund will be required to give up their right to sue GM.
GM has hired attorney Kenneth Feinberg to administer the Fund. According to the Associated Press, the company has not placed any monetary limits on payouts involving deaths or extreme injuries such as permanent brain damage, loss of limbs, paralysis and serious burns. Claims for other injuries will be determined by formulas established by Mr. Feinberg. Those claimants may be able to receive higher payouts if they are able to prove extraordinary circumstances.
