Goldberg Kohn Comments on $11 Million Settlement Ends that Whistleblower's 7-Year Battle
NEW YORK (PRWEB) December 19, 2013 -- CA Technologies agreed to an $11 million settlement for alleged fraud against the government last month, with a slice of that money going to whistleblower Ann Marie Shaw. Attorney Matthew Organ of Goldberg Kohn says the reward is well deserved after Shaw's seven year battle for justice.
Shaw was an employee of CA in 2006 when she noticed an alleged trend of double-billing customers, according to WSAV News (11.12.2013) and Newsday (11.12.13). She initially brought up her concerns within the company but says her superiors took no action.
“When a business is defrauding the federal government, any citizen can initiate the lawsuit on the government's behalf,” said Organ, whose work at Goldberg Kohn focuses heavily on whistleblower lawsuits. “Most of CA Technologies' clients were government agencies.”
Shaw's lawsuit alleged two kinds of fraud against those agencies: tampering with renewal cycles on service plans so that the agencies paid too often, and misguiding the agencies to purchase third-party software that was already included in an earlier purchase.
“It takes a lot of courage to stand up to a Fortune 500 company,” Organ said. “She staked her career on doing the right thing, and she won.”
In addition to federal government agencies, nine state governments joined the suit as well. The $11 million offer settles all of the cases. Shaw's reward is expected to come out to approximately $2 million.
