GranuFlo Recall Claims Mount, as Filings in Federal Proceeding Near 2,600, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 24, 2015 -- GranuFlo recall (http://www.granuflolawsuit2014.com/granuflo-dialysis-recall/) claims filed on behalf of individuals who were allegedly harmed by GranuFlo and NaturaLyte dialysis concentrates continue to mount in the federal litigation now underway in U.S. District Court, District of Massachusetts, Bernstein Liebhard LLP reports. According to an Updated Docket Report issued by the U.S. Judicial Panel on Multidistrict Litigation on January 15th, at least 2,575 GranuFlo lawsuits are now pending in the proceeding. This represents an increase of 286 filings since the release of the Panel’s previous update on December 15th, 2014, when 2,289 cases were reported. GranuFlo and NaturaLyte Recall
The GranuFlo litigation has been growing since June 2012, when the U.S. Food and Drug Administration (FDA) announced a Class I recall for GranuFlo and NaturaLyte, two dialysis concentrate manufactured by Fresenius Medical Care. The agency announced the recall after Fresenius issued an Urgent Product Notification in March 2012 that warned of dosage issues that could put patients at risk for metabolic alkalosis, a dangerous elevation in the blood’s bicarbonate levels which can result in serious, and potentially life-threatening, cardiovascular event. In addition to the federal cases, almost 4,000 lawsuits that put forth similar allegations have been consolidated in Massachusetts Middlesex County Superior Court since GranuFlo and NaturaLyte were recalled. According to court documents, all of the complaints pending in Massachusetts federal court accuse Fresenius of failing to provide adequate warnings regarding the serious cardiovascular risks associated with GranuFlo and NaturaLyte, and of aggressively marketing the concentrates even after those dangers became known. Among other things, the lawsuits point to a 2011 internal memo in which Fresenius notified dialysis clinics in its own network about the dosage adjustments needed to ensure the safety of patients treated with GranuFlo and NaturaLyte. Plaintiffs question why Fresenius waited until March 2012 to inform thousands of other facilities that also used the two products about this serious concern.
