Hush, INC. d/b/a Hush Nightclub, Deschamps and Johnson, Case No. 2012-72631, 125th Harris County District Court in Harris County, Texas).
According to court records, the family members of the deceased young woman sued an 18-and-over club for allegedly serving the young woman alcohol despite that fact that she was showing obvious signs of intoxication. The young woman drove herself after leaving the bar, lost control of her vehicle, and died at the scene of the accident, court documents show.
These types of cases are commonly referred to as “dram shop” cases. The term “dram shop” refers to commercial establishments that sell and serve alcohol, such as bars and nightclubs. Many states have dram shop laws that hold these commercial establishments liable if someone is injured as a result of the establishment over-serving alcohol to one of its patrons. Under Texas’ dram shop laws, (Texas Alcoholic Beverage Code §2.02) an establishment can be sued if it provided alcohol to someone who was obviously intoxicated to the point where he or she clearly posed a danger to others or to himself or herself, and this intoxication then caused damages.
While the state of Texas has these laws, it also has laws that provide bars and clubs with numerous protections against lawsuits for alleged over-service of alcohol. Out of the $225,000 settlement, the decedent’s 10-month-old son whom she left behind will receive a net settlement of about $130,000, and the father will receive a net settlement of $15,000, according to the court records.
