Hip Replacement Lawsuit News: Stryker Reaches Settlement With Plaintiffs In Recalled Rejuvenate Hip Stem & ABG II Hip Stem Lawsuits, Reports Alonso Krangle LLP
New York NY (PRWEB) November 12, 2014 -- Hip Replacement Lawsuit News: Stryker has reached a $1.425 billion agreement to compensate patients in the United States who had revision surgery to replace the company’s recalled Rejuvenate hip stem and ABG II Modular-Neck hip stem devices, reports Alonso Krangle LLP. The firm also states according to settlement documents to be eligible for compensation, hip implant recipients must have had their implants replaced prior to November 3, 2014, the date the agreement was announced by Stryker and court-appointed committees representing plaintiffs in litigation against Stryker in New Jersey’s Bergen County Superior Court and in the U.S. District Court, District of Minnesota. According to the settlement agreement, hip implant recipients who have not filed defective Stryker hip replacement lawsuits can also participate in the settlement program as long as they meet the eligibility requirements. The settlement agreement calls for patients to receive a gross base award of $300,000 for each revised hip and payments are expected to be made by the end of 2015.

According to the official Stryker lawsuit settlement website, the agreement was reached as a result of an early mediation program initiated in New Jersey’s Bergen County Superior Court where a multicounty litigation was established in January 2013 for Stryker recalled hip implant lawsuits.

Judge Brian R. Martinotti was supervising the early mediation program and other aspects of the pretrial proceedings for the 2,148 pending Stryker complaints in the New Jersey court. Stryker recalled its Rejuvenate and ABG II Modular-Neck hip stems in July 2012 due to the fretting and corrosion of its hip replacement devices at the modular-neck junction. Stryker explained during the recall that the neck components of the Rejuvenate and ABG II are made of chromium and cobalt, and the stems are coated with titanium. According to Stryker, the neck components wear against each other as the patients walks and runs, and the wearing generates metallic debris. The debris is released into a patient’s bloodstream or tissue, which can cause such problems as adverse tissue reactions, necrosis, metallosis and the need for revision surgery.

Court documents indicate that as the mediation program for Stryker lawsuits was underway in Bergen County Superior Court in New Jersey, both state and federal courts were preparing for bellwether trials. Superior Court Judge Brian R. Martinotti ordered attorneys for plaintiffs and the defendant to select cases for the bellwether trials. Judge Martinotti tentatively scheduled bellwether trials for the selected Stryker hip lawsuits on June 15, 2015 and July 13, 2015. In September, U.S. District Judge Donovan Frank ordered attorneys to submit a list of potential cases for bellwether jury trials. Bellwether trials in the federal court have been scheduled for Summer 2015.
