Hudson Valley Bank Forces Connecticut Attorneys into Ethical Quagmire
Stamford, CT (PRWEB) July 29, 2013 -- On May 10, 2013, Daniel F. McGuire of D.F. McGuire & Associates, LLC, filed a class action (Docket No. FST-CV13-6018303-S) against Hudson Valley Bank on behalf of all Connecticut lawyers with Interest On Lawyers’ Trust Accounts (IOLTA) at the bank. The complaint alleges that, in violation of state law, Hudson Valley Bank unilaterally and without permission moved attorney IOLTA accounts out of the State of Connecticut. These accounts contain funds belonging to clients and third parties. It is alleged that these transfers have involuntarily placed every Connecticut based attorney with a Hudson Valley Bank IOLTA out of compliance with the Connecticut Rules of Professional Conduct, which require a lawyer to maintain IOLTA funds within the state. IOLTA accounts are bank accounts in which lawyers are required to keep funds belonging to clients and others. The lawsuit asks for an injunction to remedy this.
A judge of the Superior Court of Connecticut recently sustained the complaint against Hudson Valley Bank's motion to strike it.
