Charleston, South Carolina (PRWEB) September 30, 2016 -- Hughey Law Firm, a Charleston, South Carolina-based personal injury law firm, achieved a $2,000,000 settlement against a local Buffalo Wild Wings franchise ($1,925,000) and its parent company Buffalo Wild Wings, Inc. ($75,000) for the estate of their client Forrest Carlton, who was killed in a hit-and-run accident by an 18-year-old, allegedly intoxicated driver on December 8, 2013. The settlement allocated $200,000 to the survival claim, while the remaining $1,800,000 was allocated to the wrongful death claim. According to court documents, on the night of December 7, 2013, multiple employees of the Buffalo Wild Wings (BWW) franchise located in Summerville, South Carolina, allegedly served and sold Daniel Shirley large quantities of alcohol even though he was only 18-years-old at the time and possessed no form of false identification. After drinking until last call shortly before 2:00 AM, Shirley allegedly left BWW in an intoxicated condition and drove approximately 20 miles until his vehicle collided with Forrest Carlton, who was walking along Ashley River Road in Charleston, South Carolina. Shirley purportedly left the scene of the accident and would not turn himself into local authorities until several days later. Unfortunately, Carlton succumbed to his injuries on December 8, 2013.
“This was a case that involved a very tragic set of circumstances culminating in the death of Forrest Carlton. Forrest was loved by everyone that came into contact with him, and he was supported by a wonderful family. Forrest displayed a love and joy that was unaffected by the fact that he was both autistic and non-verbal,” said attorney Nathan Hughey. “His life was cut down by an underage driver who had allegedly been served alcohol repeatedly at a local Buffalo Wild Wings, according to his testimony. Witnesses testified to numerous other alcohol violations at the restaurant as well. We hope that this settlement makes a difference in the implementation of safe alcohol service not only at local Buffalo Wild Wings restaurants, but nationwide. While nothing will ever bring Forrest back, we hope and believe that this settlement effectuates the change necessary to ensure that nothing similar happens to anyone else.”
