NEW YORK, NY (PRWEB) July 10, 2015 -- A personal injury law firm with a track record as prominent trial lawyers recently obtained an $8.5 million dollar verdict, when their client was injured after debris from a ceiling collapsed fell onto her, court documents show.
According to court documents, on August 14, 2010, the client was taking a shower when suddenly the ceiling above her collapsed, causing her to fall and lose consciousness. She was found by her husband in the bathtub moments after the accident. He immediately called 911 and an ambulance arrived and took her to Lutheran Hospital. She regained consciousness once at the hospital, where she underwent a CT scan of her head and brain, the results of which fortunately turned out to be negative. The client was discharged and returned home the same day.
A few days later the client began treatment with a physical therapist for pain in her neck and back, but this did not relieve the pain, court documents indicate. She subsequently had spinal surgery, but the pain continued, and was treated by a pain management specialist who gave her several cervical and lumbar epidurals, but to no avail, and he client’s pain in her neck and back continues to this day, court documents state.
The case went to trial on March 4, 2015 in Kings County Court (Case No. 2827/10). Attorney William Schwitzer represented the Plaintiff, against the building manager. William Schwitzer contended that his client had made several complaints to the building’s Management about the wet, damp and bubbling ceiling for months prior to this accident, court documents said. The defendant contended that they were not liable for this accident and impleaded a Third-Party Defendant, the contractor, court documents continued. The building management company believed that the contractor they installed faulty sheetrock in the weeks prior to the accident, the documents added.
The contractor, through their own counsel, contended that they were only instructed to install sheetrock by the building’s Management, the court documents noted. The contractor further contended that they were not instructed to fix any leaks and were told by the building’s Management that everything else was fixed, court documents also say.
After approximately a week’s testimony, the jury found the building’s Management to be 100 percent liable for the accident, court documents state.
It took just 35 minutes of deliberation for the jury to find that the Plaintiff’s injuries and surgeries were causally related to the ceiling collapse, and awarded William Schwitzer’s client $8.3 million dollars. Her husband was also awarded $200,000 for loss of services.
