Judge Grants Order to Stop All Construction on Baylor University’s McLane Stadium Pending Houston Law Firm’s Investigation of the Drowning of a Construction Worker
Houston, Texas (PRWEB) February 19, 2014 -- A McLennon County Judge has granted VB Attorneys’ petition for a temporary restraining order to stop all construction on the new Baylor University football stadium as they investigate the death of a worker who drowned. According to WacoTrib.com, Jose Dario Suarez, 55, died January 28th, 2014, when the equipment to which he was tethered collapsed and fell into the frigid waters of the Brazos River. Mr. Suarez was trapped underwater, unable to release his safety harness. Another worker was able to release his safety harness and was treated for hypothermia. It took divers four hours to recover Suarez’ body, which was still attached to the equipment when it was found on the bottom of the river (1).
Suarez is survived by his wife, two daughters, a son, and his mother. OSHA is no longer on site and has not released any information on its investigation. On February 18, 2014, VB Attorneys filed a petition for a temporary restraining order (Cause No. 2014-585-4 in the 170th District Court of McLennan County, Texas) against Baylor University, Derr and Isbell Construction, and Flintco LLC, asking the Judge to order the school and construction companies to stop work at the stadium and to preserve material evidence, which at this time is in jeopardy of being discarded, altered, or destroyed in the ongoing construction activities. As of February 19th, 2014, the TRO has been signed, ordering an immediate stoppage of the stadium construction.
According to baylorbears.com, the university has a “construction cam” (2). Vuk Vujasinovic, lead counsel for the family has noted, "The Judge has granted our TRO to have the school and construction companies to immediately turn over this video, and to preserve all other evidence. In addition, the judge has approved our order to stop all construction activities at McLane Stadium so we may inspect the site and conduct our own investigation. It appears that after OSHA left the area, the football stadium construction activities resumed,” states Mr. Vujasinovic. He will begin an independent investigation immediately.
