Palm Beach Gardens, FL (PRWEB) May 17, 2017 -- Kaplan Sconzo & Parker, P.A. receives Multi-Million Dollar Verdict in Palm Beach County Jury Trial in Homeowners’ Association Negligence Case No. 2014-CA-005525, 15th Judicial Circuit in and for Palm Beach County, Florida.
Kaplan Sconzo & Parker, P.A. Attorneys Joseph Fields and Gregory Sconzo secured a $3.7 Million dollar verdict for their clients in a Homeowners’ Association Negligence Case following a rear end collision that occurred within the development. The case involved a rear end accident that occurred at night within the Association. Mr. Fields and Mr. Sconzo presented evidence supporting that the Association allowed street parking despite the Association’s recorded documents prohibiting such street parking. This decision to allow street parking resulted in a longstanding parking problem with cars parking on both sides of the street creating a gauntlet or bottleneck wherein only one car could pass at a time.
On the day of the accident, evidence revealed that the clients were driving home and had entered the community where they lived. The clients were forced to stop due to the parking problem of cars parked on both sides of the street and a car traveling in the opposite direction preventing them from continuing forward. While stopped and awaiting the oncoming car to clear the parked vehicles, the clients were rear ended.
The injured client suffered debilitating injuries to his neck and low back. As a result, the injured client underwent significant medical treatment including numerous epidural steroid injections, a failed laminectomy, and the insertion of a pain stimulator.
Following a ten (10) day trial in Palm Beach County involving fifteen (15) witnesses, the jury returned a unanimous verdict finding that the Association acted negligently and that the negligence of the Association was a contributing cause to the accident. The jury awarded damages for past and future medical bills, past and future loss wages, pain and suffering, and loss of consortium.
