Laura Buccellati Seeks Crowd Funding To Defend Her Leather Goods Company In Court
Miami, FL (PRWEB) January 17, 2014 -- Laura Buccellati and Lily Azel, business partners in Laura Buccellati, LLC, announced they are seeking crowd-funding on Indiegogo to help pay attorneys fees for their day in court. Continuous legal maneuvers by Laura’s uncle Gianmaria Buccellati have practically exhausted their resources.
Gianmaria Buccellati is suing his niece, Laura and Lily Azel, alleging trademark infringement. Gianmaria who until recently headed up the jewelry company, retired after selling a 70% stake in Buccellati Holding Italia, SpA for $100 million to an Italian investment group.
Originally Buccellati, Inc filed in US District Court – Southern District of New York as Case 1:11-cv-07268-PGG. This case was dismissed on March 27, 2013 for lack of personal jurisdiction. Buccellati, Inc had relied for jurisdiction of an internet sale of a single handbag made to a private investigator hired by Buccellati, Inc. The leather goods company operated by Laura Buccellati and Lily Azel, founded in 2009, is a two-woman operation based in Miami, Florida.
Buccellati then refilled their complaint in the US District Court – Southern District of Florida Case 1:13-cv-21297-KMM.
Laura Buccellati, LLC in her Defendants’ Answer, Affirmative Defenses and Counterclaims (Case NO.: 1:13-cv-21297-KMM page 7) contends that:
1. Plaintiffs’ lawsuit against Defendants constitutes nothing more than a power play and family vendetta by Italian members of the extended Buccellati family, in order to crush the legitimate rights of Laura Buccellati, an American family member, who is residing and doing business in South Florida, in order to stop her from using her own full name in connection with goods (leather handbags and leather belts) which she designs and sells, which are not even sold by the Italian family members. Counterclaim Plaintiffs Laura Buccellati and her company Laura Buccellati LLC seek declaratory and injunctive relief to establish their legitimate and superior rights to use of the name Laura Buccellati in connection with leather handbags and leather belts, and to cancel the U.S. trademark registrations that the Italian members of the extended family fraudulently obtained.
