The initiative reduces penalties for some non-serious and non-violent property and drug crimes that are currently felonies, making them misdemeanors instead. It applies to shoplifting, grand theft, and writing a bad check, but only if the value alleged does not exceed $950. It also applies to simple possession of many illegal drugs. Proposition 47 is retroactive, so any person convicted of these charges may take steps to have their conviction reduced to a misdemeanor.
A recent LA Times article stated, “Prison officials said they have identified 4,770 felons in custody who are eligible to seek resentencing. And L.A. prosecutors have identified almost 4,000 offenders in the pipeline between arrest and sentencing who might qualify for more lenient treatment under the new law. To get released, current inmates must prove that they are not a threat to the public.”
