Layfield & Wallace File Wrongful Death Suit Against Alleged Drunk Driver Who Killed Sleeping Teen

According to court documents, on April 20th, 2014, at approximately 3:15 am, 16 year old Giselle Mendoza was sleeping in her bedroom in the home she shared with her mother at 1005 East Avenue R in Palmdale, California. 20 year old Roberto Rodriguez was driving home drunk from a friend’s house when he fell asleep at the wheel, lost control of the Nissan Pathfinder he was driving, and slammed into the wall of the Avenue R apartment, which was the Decedent’s bedroom. The Decedent, a sophomore at the local high school, was pronounced dead at the scene of the accident. Layfield & Wallace filed suit on March 16th, 2015 against alleged drunk driver Roberto Rodriguez and Bo Kun Song owner and manager of the residence where the Decedent lived. The Plaintiff alleges the causes of action are motor vehicle negligence, premises liability, wrongful death and negligence. Giselle Mendoza is survived by her parents, Maria and Alberto Mendoza and her sister Yadira Mendoza. The case is expected to be tried in November, 2016. The court of record is Stanley Mosk in Los Angeles.
