Layfield & Wallace settle negligence, strict liability and loss of consortium suit against Budget Truck Rentals

The case, “Curtis Yow and Ann Yow v. Pahrump Rentals, Inc., Budget Truck Rentals, LLC” (case number SICV CV 1456663) originally filed on May 22nd, 2014, settled for $225,000.00 on March 23rd, 2015.
According to court documents, on August 7th, 2012 Mr. Curtis Yow and Mrs. Ann Yow, were preparing for a household move from Pahrump, Nevada to Carson City, Nevada and went to Pahrump Rentals, Inc., an authorized dealer of Budget trucks and trailers. They rented a 24 foot 2005 GMC C3500 truck and 2011 Dethmers trailer to assist with their move. Mr. and Mrs. Yow loaded their household items into the Budget truck and hitched their Jeep Cherokee to the trailer. The next morning, on August 8th, 2012, Mr. and Mrs. Yow loaded the last of their belongings into the truck, kenneled their dogs multiple pets, the equivalent of their children, and departed on their move. Mr. Yow, a former Marine, had experience driving and operating heavy machinery, much like the Budget truck he was driving. Allegedly, as they were driving on SR 168, they encountered a downhill slope and Mr. Yow noticed that despite trying to brake slightly, his speed increased from 30 miles per hour to 40. He then began applying brakes based on his previous training the speed continued to increase to no avail. In a last minute effort to slow the truck, he pulled the emergency brake which also produced no result. Mr. Yow lost control of the truck, it hit an embankment, causing the truck to flip and crash. In addition to the traumatic experience of crashing the truck and damaging many of the things they were moving, two of their beloved cats escaped and were never recovered. Mr. Yow sustained a serious closed head injury that affects his ability to find employment. Their suit against Budget and Pahrump rentals allege negligence, strict liability and loss of consortium.
