Levin, Papantonio Law Firm Announces $2.475 Billion DePuy Hip Settlement
Pensacola, FL (PRWEB) November 28, 2013 -- Johnson & Johnson, the parent company of DePuy orthopedics, which was responsible for manufacturing and marketing the metal-on-metal hip implants, the DePuy ASR XL, has agreed to a $2.475 billion DePuy hip settlement. The settlement covers patients who have undergone a revision surgery as of August 31, 2013, according to Court documents in MDL 2197.
The DePuy ASR XL was recalled in August of 2010 for issues resulting in an exceptionally high rate of revision among patients implanted with the device. These patients would often have to undergo a lengthy and painful process to have the device removed and replaced. The device was suspected of causing metallosis which resulted in cobalt and chromium poisoning. The device was originally approved for market through the FDA’s 510(k) approval process, according to Court documents.
Levin, Papantonio attorneys Benjamin Gordon and Daniel Nigh have been working with clients and pursuing recovery against DePuy for the injuries they suffered. These efforts have included working in coordination with numerous firms across the nation in a Multi-District Litigation on behalf of thousands of clients. Millions of documents have undergone review and depositions have been taken across the United States and Europe.

Individuals who had not yet undergone a revision surgery as of August 31, 2013 are not eligible for the current DePuy hip settlement. However, the Levin, Papantonio law firm will continue to fight for the rights of those individuals and continue its investigation of their claims.
Levin, Papantonio shareholder Ben Gordon, who is a member of the Plaintiffs' Executive Committee and the Settlement Oversight Committee ("SOC"), commented:
“This recent development in the litigation, which will resolve the claims of many patients in the near future, will provide them with fair compensation for the pain and other damages they have suffered because of their defective ASR hip implant."
