Lipitor Lawsuit Conference Scheduled for December, Bernstein Liebhard LLP Reports

According to court documents, the litigation will convene its next Status Conference on December 18th at 10:00 a.m. The Court has directed Lead Counsel for Plaintiffs and Defendants to meet and confer, and to submit a Joint Status Report at least five business days prior to the Conference. Lipitor Diabetes Allegations
Lipitor is a statin that is used to lower LDL or “bad” cholesterol and reduce the risks of heart attacks, strokes and certain heart surgeries in people who have heart disease, as well as those who have risk factors for heart disease. In February 2012, the U.S. Food & Drug Administration (FDA) announced that the labels of Lipitor and other statins would be updated to include new information about their potential association with Type 2 diabetes. The announcement followed the publication of a study in JAMA: Internal Medicine the previous month which suggested that post-menopausal women treated with statins faced an increased risk of developing new-onset Type 2 diabetes. *
Since then, court documents indicate that more than 1,400 Lipitor lawsuits have been filed in the District of South Carolina, all which accuse Pfizer Inc. of concealing information about the drug’s association with diabetes in order to protect sales of the medication. Plaintiffs further allege that had Pfizer provided doctors and the public with adequate warnings about the risk of diabetes, they would have chosen not to use the medication, or could have diligently monitored their blood glucose levels in order to avoid developing the disease.
