Lipitor Lawsuit News: Newly-Released Joint Status Report Indicates Discovery Well Under Way in Federal Multidistrict Litigation

According to a Joint Status Report released by the Court on June 18th, Pfizer, Inc. has produced additional documents and information relating to the sale and marketing of Lipitor. The report also notes that the parties have been scheduling and conducting depositions of non-party fact witnesses for the litigation’s first bellwether trials. Court documents indicate that more than 2,300 Lipitor lawsuits have been filed in the District of South Carolina on behalf of individuals who allegedly developed Type 2 diabetes due to their use of the cholesterol-lowering medication. The litigation involving the drug’s alleged association with diabetes has been growing since February 2012, when the U.S. Food & Drug Administration (FDA) required all statin manufacturers to update their product labels with information regarding the medication’s potential to effect blood glucose levels. The FDA’s mandate was prompted by a study published the previous month in JAMA: Internal Medicine suggested that post-menopausal women treated with statins faced an increased risk of developing new-onset Type 2 diabetes.*
According to court records, all of the lawsuits pending in the federal proceedings accuse Pfizer of concealing information regarding Lipitor’s association with diabetes from the public and medical community. Plaintiffs also assert that the modifications made to the Lipitor label in response to the FDA’s 2012 mandate still do not adequately warn patients about this potential complication.
