Lipitor Lawsuits Move Forward, as Judge Prepares to Select Cases for Bellwether Trials, Bernstein Liebhard LLP Reports

Court documents indicate that more than 2,000 Lipitor diabetes claims are currently pending in the multidistrict litigation underway in South Carolina. Product liability cases involving the cholesterol-lowering medication have been mounting since February 2012, when the U.S. Food & Drug Administration (FDA) announced that the labels for Lipitor and other statins would be updated to include new information about their potential association with Type 2 diabetes. The label change was prompted by the publication of a study in JAMA: Internal Medicine the previous month which suggested that post-menopausal women treated with statins faced an increased risk of developing new-onset Type 2 diabetes. *
According to court documents, all of the Lipitor lawsuits filed in the federal proceeding accuse Pfizer Inc. of endeavoring to protect sales of the drug by concealing its alleged association with diabetes. Plaintiffs also assert that the label modifications made by Pfizer in the wake of the FDA’s 2012 warning still do not sufficiently inform patients about the potential association between Lipitor and diabetes.
