According to the Ministry of Health and Long-Term Care, chronic pain affects 1 in 5 Ontarians. While being able to receive proper treatment is necessary to chronic pain patients, it isn’t always possible. There is a shortage of family physicians in Ontario that are accepting new patients. There are long waiting periods to be accepted into chronic pain facilities. Access to treatment may just not be possible for some claimants.
Insurance companies may look at a claimant who is not currently undergoing treatment or under the “regular” care of a physician and use this as a reason to deny benefits. If the policy says participate in treatment, and it seems to them that the claimant is not compliant in doing so, they may make a decision to terminate benefits. This is why it is important that people receiving long-term disability benefits read over their policies and be informed as to their duties as a claimant.
Waxman advises that it is important for anyone receiving long-term disability benefits to know that all efforts should be made to participate in necessary treatment, obtain appropriate medical care and document all attempts to obtain treatment if treatment is not available.
