Luminara Files Patent Infringement Lawsuit, Presses for Trial
Minneapolis, Minn. (PRWEB) August 20, 2014 -- Candella LLC, in cooperation with Luminara Worldwide LLC, filed a lawsuit in U.S. District Court for the District of Minnesota to stop the alleged infringement of U.S. Patents held by Candella LLC and to press for a trial by jury.
The lawsuit is part of Candella LLC and Luminara Worldwide LLC’s continued activity to aggressively protect its customers as well as its patents, which represent technology used to create Luminara’s collection of flame-replicating designer candles.
According to court documents, Candella LLC, the exclusive licensee of the patents, contends these companies (Liown Electronics Co. Ltd, Shenzhen Liown Electronics Co, Ltd, and Liown Technologies/Beauty Electronics LLC) have infringed and continue to infringe these patents, and seeks to invalidate one patent Liown recently secured covering minimal changes to technology components. In response to the Candella LLC suit, Liown filed its own legal action in federal district court alleging patent infringement by Luminara.
Luminara flameless candles utilize proprietary technology covered by the patents, which were developed by Disney Enterprises, Inc. Luminara is the exclusive, worldwide licensee of Disney’s flameless candle technology. As court documents detail, initial patents for this technology were filed in 2008, two years prior to Liown filing the disputed Liown patent and the documents contend Luminara candles do not utilize any technology invented by Liown.
Legally, a patent only grants the right to exclude others. It does not grant the right to make, use or sell a patented product. It is well established that a party cannot take a patent of another and make only minimal changes to the patented technology. In such a case, that party is an infringer, and may be sued for infringement.
