Marcus Family Law Center Raises Awareness for Special Needs Children in the Courts
San Diego, CA (PRWEB) July 16, 2014 -- Ethan J. Marcus, attorney, certified family law specialist, and current president of Marcus Family Law Center, PLC is spearheading this mission. Inspired by the successful campaigns to promote mandatory judicial education in the fields of domestic violence, illicit drug use, alcohol abuse, and child abuse, Marcus Family Law Center, PLC is seeking to open the dialogue that will set the stage for the establishment of minimum educational requirements and informational services in order to get the news out to judicial officers that special needs kids are special and deserve special treatment.
“The challenge is that special needs children often benefit from placement with a single parent with visitation to the other parent (as opposed to true shared custody). 50/50 physical custody’ and ‘joint legal custody’ are easy decisions for a court to make, as such decisions have the appearance of ‘fairness’ to parents, but that is rarely what is best for special needs children. In fact such decisions can be quite damaging, if they result in taking the children away from their familiar supports and routine. We have learned that most special needs children would do best if they slept and awoke in the same place to prepare for school each week,” said Ethan Marcus. In domestic violence, substance abuse, and child abuse cases, the court might find it easier to demonize one parent and place the children with the other, in the case of special needs children, the court may be faced with the tough choice of picking between two perfectly good parents without any ability to find “fault” in either one. This requires special sensitivity and decisiveness that can only come from training and education.
