Mastec North America, Inc. Faces A Lawsuit Filed By Blumenthal, Nordrehaug & Bhowmik That Claims The Company Failed to Pay Their Field Technician Overtime Wages
San Bernardino, California (PRWEB) January 15, 2015 -- On December 26, 2014 the San Diego employment law attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action Complaint against Mastec North America, Inc. alleging the satellite television installation and service company failed to pay their Field Service Technicians, who were paid on an hourly basis, the proper amount of overtime compensation and allegedly failed to provide these employees the legally required meal and rest breaks. The Mastec North America, Inc, overtime lawsuit, Case No. CIVDS 1419318 is currently pending in the San Bernardino County Superior Court for the State of California.
According to the class action complaint, Mastec North America, Inc. paid their Field Service Technicians a non-discretionary bonus and also paid these employees a stipend for being scheduled to work on-call hours. The lawsuit argues that under California overtime laws the bonus compensation and on-call stipend received by Mastec North America employees should have been included in the employees hourly rates for the purposes of calculating the correct overtime rates. As a result of the alleged illegal overtime calculations conducted by Mastec, the lawsuit claims other non-exempt employees who worked for Mastec were not correctly paid all their overtime wages.
The Complaint further claims that as a result of the rigorous workload placed on the Field Service Technicians, these employees were required to allegedly record fictitious meal periods and clock out for a thirty (30) minute meal break when in fact these employees were not at all times provided an off-duty meal break. California law requires employees who are paid on an hourly basis to take a thirty minute uninterrupted meal break prior to working five hours. The penalty for a violation of California's meal break law is one hour of pay.
